10:00 – 10:30- Arrival

10:30 – 10:45- Welcome & Introductions

  • Welcome from Hebrew and Essex Universities.
  • Introductions from participants.

10:45 – 13:00- Presentations & Initial Discussion

  • Presentations by a number of participants.
  • Initial discussion on topics arising. One key point of interest is how to ensure divergent viewpoints or ‘points of friction’, in the absence of a more traditional adversarial process.

13:00 – 13:45- Lunch

  • Lunch will be held in the meeting room, or adjacent.

13:45 – 15:15-  Perspectives on Oversight and Authorisation

  • What is required of agencies, in terms of how a request for authorisation is formulated?
  • Can best practice be identified with respect to how agencies present their case, particularly in terms of the necessity requirement, and available alternatives?
  • How does authorisation occur in jurisdictions present?
  • Canvas opinions regarding the UK ‘double lock’ procedure, and the appropriate level of review that should be conducted by the Investigatory Powers Commissioners.
  • What is the appropriate relationship between the authorisation process and subsequent review/investigation of agency practice? Is there a risk that review could be used to mitigate the risk of more uncertain authorisations?

15:45 – 17:00: Agency Procedures and Perspectives

  • What internal procedures do agencies have in place to ensure compliance?
  • How do internal procedures relate to national oversight mechanisms?
  • Has oversight affected the work, including effectiveness, of different agencies? Is there a danger that agencies are becoming risk averse?

17:00- Drinks

18:00- Dinner at The Brasserie, Wivenhoe House
